LETTER OF COMPLAIN AGAINST BAUCHI STATE SHARI’AH COMMISSION, DA’AWAH
ISLAMIC EDUCATION & ONE MALLAM SHAGARI FOR WRONGFUL CONFINEMENT &
FORCEFUL CONVERSION OF16 YEARS OLD GIRLS TO ISLAM:
Prison Inmate Development Initiative (PIDI) is a Non-Governmental
organization, with the sole aims to promote access to Social Justice,
Security, Information on Crime Management & Control, Education,
Rehabilitation, Conflict Resolution, Strategies alliance and to create
enlightenment among members of the society on government activities.
The function of the Nigeria criminal justice system, include; rights
and welfare of the marginalized vulnerable groups to ensure equal
protection. PIDI is a Member; Human Rights Agenda Network (HRAN),
Centre for African Human Rights (CEHURI), Coalition of Northeast Human
Rights Defenders (CNHRD), Child Protection Network (CPN) and Nigeria
Coalition for International Criminal Court (NCICC) and among others.
We hereby write to the National Human Rights Commission (NHRC), for
prompt action to stand as Defenders to the family of Mr. Christopher
Onah, for their fundamental human rights as enshrine in 1999
constitution of the federal republic of Nigeria. In respect to this
incident:
1. It is in the statement of the victim family complaint in our office
(PIDI) dated 25th November, 2015; at about 11:01am.
a. As enclose that he (complainant) resides in Katanga Giwa Village
in Toro LGA, in Bauchi State.
I. Sex male.
II. Age: 56 years old
III. Marital Status: Married
IV. Occupation: Trade
V. Dependant: Twenty (20)
VI. Religion/Faith: Christian
VII. LGA: Egboeze South
VIII. State of Origin: Enugu
IX. National: Nigeria.
b. That he has a daughter, one Linda Christopher Onah, 16 years old,
who is schooling at Ibogwa Girls Secondary School in Egboeze South of
Enugu State.
c. That on the 19th November, 2015; when he came back from where he is
trading he saw his wife making calls, then he asked what was the
matter and she told him that one of their tribal person saw Linda
Christopher Onah they daughter in Tarsha Durumi village in Toro LGA of
Bauchi State; precisely, their former resident.
d. That he was shock and said to his wife (Justine Christopher Onah),
Linda supposed to have been in Enugu by now schooling and why is she
in Bauchi without our consent.
e. That they contacted their village by phone, where their daughter
(Linda) supposed to have been under the custody of her father sister
in Egboeze town and the sister told them she don’t know her where
about for the past one day.
f. That he received a letter from Bauchi State Shari’ah Commission,
notified him that their daughter (linda Christopher Onah) has been
converted to Islam which was brought to the Sharia commission by
Da’awah & Islamic education an NGO.
g. That on 21st November, 2015; Mr. Christopher Onah’s families & two
other when to the Shari’ah commission demanding to see their daughter
but they were denied access to see their biological daughter.
h. That his daughter (Linda) is a minor; she cannot take decision for
herself to be converted to another faith without his consent.
2. Further Investigation carryout on Bauchi State Shari’ah
Commission by Prison Inmate Development Initiative (PIDI) Human Rights
Defenders, dated 27th November, 2015; at about 10:30am.
a. That the Shari’rah commission used to receive new convert usually
brought to them by Da’awah & Islamic Education an NGO.
b. That the Shari’ah commission will keep the convert in their custody
and they will further notify the parent or guidance about the
convertion of their child.
c. That Linda has chosen to change her name to Aisha Christopher
according to Islamic doctrine.
d. That the Shari’ah commission will keep the convert in their custody
for one (1) year or less than for protection.
e. That when there is peace between the convert and her parent she
will be allow to go back home.
3. Investigation carryout on Linda Christopher Ohan by Prison Inmate
Development Initiative (PIDI) Human Rights Defenders, in Bauchi State
Shari’ah Commission, dated 27th November, 2015; at about 11:25 am .
a. That she came to Bauchi on the 19th November 2015 from Igboeze town
in Enugu State.
b. That she settled in Tarsha Durumi village in Toro LGA of Bauchi
State; precisely, their former resident.
c. That she is in JSS two (2), Schooling at Ibogwa Girls Secondary
School in Egboeze south of Enugu State.
d. That she was converted to Islam on the 19th November 2015; by one
Mallam Shagari who is a tailor by profession and it has two waves.
e. That she was brought to shari’ah commission by the same Mallam
Shagari whom is their former neighbor.
f. That she do not have any problem or conflict with her parent in
Bauchi and that of her Aunty in Enugu State.
g. That presently the shari’ah commission handed over her to a Man to
be her guidance, which she did not even knows his name.
h. That she will like to marry.
4. IT IS our submission that every citizen is entitled to equal
protection of the law, without discrimination on any grounds, and
especially against violence and other threats to both the minor and
her family; and that of their fundamental human rights as enshrines in
chapter four (4) of the 1999 constitution of the Federal Republic of
Nigeria. Sir, we urged you to consider the following basis on our
investigation:-
a. That there is a clear violation of threat to life and rights to
dignity of human person; (Chapter 4 Section 33 and 34).
b. That there is clear violation of family and private life; (Chapter
4 Section 37).
c. That there is a clear violation of liberty, prima facie offence of
wrongful restrain and wrongful confinement; (Chapter 4 Section 35).
d. That there is a clear violation of freedom of movement, prima facie
offence!! (Chapter 4 Section 41). And
e. That there is clear indication of child abuse; The child rights Act
was adopted in Nigeria in 2003 and UN convention on the Rights of the
Child (1989), which has been signed by over 190 countries including
Nigeria.
In light of the above background, and in order to be able to
effectively ensure equal protection in the incident. We hereby humbly
and respectfully apply for the probe underline reference and herein
after annex are enclose on other related case of one Blessing Gopep 12
years old girl by the same perpetrators, Bauchi State Shari’ah
Commission and Da’awah & Islamic Education an NGO, which the case is
still pending.
